These Terms and Conditions ("Agreement") constitute a binding legal agreement between you ("You," "Your," or "User") and The New Yorker Experience ("We," "Us," or "Our"), the provider of billboard display services in Times Square ("Service" or "Services"). By accessing our website, purchasing any of our Services, or submitting any content for display on our billboard, You agree to be bound by this Agreement and our Privacy Policy. If You do not agree with these Terms, do not use or purchase our Services.
PLEASE READ CAREFULLY: ALL SALES ARE FINAL. OUR SERVICES ARE NON-REFUNDABLE AND NON-CANCELLABLE. BY PROCEEDING WITH A PURCHASE, YOU EXPRESSLY AGREE TO THESE TERMS.
1. Description of Services
We provide a digital service that allows individuals to upload personal photographs for scheduled display on a billboard located in Times Square, New York City. All bookings include a confirmation email with an itinerary of the scheduled display time and date, which constitutes delivery of services. This is a digital, one-time-use service and does not include any tangible goods.
IMPORTANT: We currently only display static images (photographs). No videos or animations are accepted. The billboard service is available for personal use only. No business, promotional, advertising, or commercial content is permitted.
2. No Refunds / Final Sale Policy
All purchases are final, non-refundable, and non-transferable, without exception. By completing a purchase, You acknowledge that You have reviewed the date and time of display and understand that The New Yorker Experience will render the service as described.
Once your image and display itinerary are confirmed via email, no changes or cancellations will be permitted. You understand and agree that chargebacks, disputes, or payment reversals will not be tolerated, and The New Yorker Experience reserves the right to pursue legal remedies in the event of a fraudulent or unjustified chargeback.
3. Content Submission & Restrictions
By submitting content, You represent and warrant that:
- You own all rights to the image or have secured appropriate permissions.
- The image contains no business logos, commercial references, calls-to-action, promotional messages, or advertising.
- The image contains no video, animated elements, or overlay text of any kind.
- The content is respectful and free from hate speech, nudity, explicit or graphic content, political messages, illegal activity, or any content deemed offensive or inappropriate by our discretion.
The New Yorker Experience reserves the right to reject any submission, at any time and for any reason, including failure to meet our guidelines. No refund will be issued if your content is rejected due to a violation of these terms.
4. Display Terms
Once scheduled, your image will appear on our Times Square billboard according to the itinerary sent to your email. The display time may vary slightly due to technical, operational, or environmental factors beyond our control. By purchasing our Service, You agree that minor fluctuations in timing or visibility do not constitute failure to perform or grounds for a refund.
5. Use of Content
You grant The New Yorker Experience a limited, royalty-free, non-exclusive license to use, reproduce, and display Your content solely for the purpose of fulfilling our Services. You understand and agree that your image may be viewed, photographed, or shared by third parties in public, and that The New Yorker Experience is not responsible for any third-party use of Your content.
6. Age Restriction
You must be at least 18 years of age to use our Services. If You are under 18, You must have a parent or legal guardian agree to these Terms on your behalf.
7. Limitation of Liability
To the fullest extent permitted by law, The New Yorker Experience shall not be liable for any indirect, incidental, special, or consequential damages, including loss of visibility, missed photo opportunities, emotional distress, or any other harm resulting from the display of Your content.
8. Chargeback Policy
All purchases are final. Attempting to dispute a charge or file a chargeback after receiving the itinerary or after Your image has been scheduled may be deemed fraud. The New Yorker Experience reserves the right to report such activity to the appropriate authorities, collection agencies, or legal representatives.
9. Indemnification
You agree to indemnify and hold harmless The New Yorker Experience, its affiliates, employees, and agents from and against any and all claims, losses, damages, liabilities, and expenses arising from Your content or any violation of this Agreement.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any disputes shall be brought in a court of competent jurisdiction in New York County, New York.
11. Changes to Terms
The New Yorker Experience reserves the right to update or revise these Terms at any time, without prior notice. Your continued use of the Service after such changes will constitute acceptance of the new Terms.
